Abstract
摘要:本計畫探討中美兩國競爭過程中,中國廠商的阻撓制裁(sanctions-busting)現象以及美國政府的履行制裁(enforcement)行為。首先,本計畫將以美國對伊朗、北韓的制裁為案例,釐清與上述兩國往來的中國廠商背景,分析在美國制裁壓力下,為何有些廠商仍然冒險維持與被制裁國的商貿關係。其次,本計畫將解釋為何美國司法部、商務部、財政部等部門,對中國廠商有選擇性執法的狀況,例如刻意針對華為,卻允許中興通訊繳納罰款和解,又坐視中石油集團持續向伊朗購買原油。筆者預計採取混合研究法,先蒐整相關政府與非營利組織的一手調查報告,製作以廠商為分析單位的創新數據庫。接者筆者會使用統計分析法,了解主要解釋變項的影響程度與範圍,最終輔以歷史案例比較法以及深入訪談法。據此,筆者可以檢證經濟制裁相關理論,是否仍適用於中美競爭過程的經濟衝突,或者有建構新理論的必要。筆者預期本計畫將可產出至少6篇期刊文章,並可匯聚成1本專書出版。
Abstract: This proposal aims at explaining Chinese firms’ sanctions-busting behavior and the US government’s enforcement. First, I plan to investigate the characteristics of Chinese firms that have violated the US sanctions against North Korea and Iran. The purpose is to understand why they maintain the business tie with sanctioned states under the US pressure. Second, I seek to expound the sanction strategy of the US Department of Justice, Commerce, Treasury, etc. Take the Treasury Department, for example. It threatened Huawei, settled the dispute with ZTE, and disregarded CNPC illegal purchase of oil from Iran. To explain the US selective sanctions, I will use a mixed-method and generate an original firm-level sample based on first-hand archives. Then, I will conduct statistical analysis to evaluate the validity of proposed arguments and verify the explanatory power with comparative historical cases and in-depth interviews. The findings can contribute to the scholarship on how sanctions work to alleviate or escalate the conflict between China and the US. In sum, I expect to publish six journal articles and a book with this grant’s support.
