標題: | 區域整合與亞洲憲政主義:台灣面對亞洲整合的憲法議題 | 作者: | 葉俊榮 | 關鍵字: | 轉型憲政主義;跨國憲政主義;區域憲政主義;全球憲政主義;區域整合;全球化;亞洲整合;亞洲憲政主義;東南亞國協;東亞經貿論壇;Transitional Constitutionalism;Transnational Constitutionalism;Regional Constitutionalism;Global Constitutionalism;Regional Integration;Globalization;Asian Integration;Asian Constitutionalism;ASEAN (the Association of Southeast Asian Nations);APEC (Asia-Pacific Economic Cooperation) | 公開日期: | 2003 | 出版社: | 臺北市:國立臺灣大學法律學系暨研究所 | 摘要: | 二十世紀末期因為第三波民主轉型所產生的「轉型憲政主義」(Transitional constitutionalism),其擴張方式與傳播速度,已經清楚表現出「區域化」與「全 球化」的特質,從而衍生出「跨國」、「區域」或「全球」的憲政主義。此一 趨勢,與刻正進行中、因應網路科技與後冷戰世界版圖重整所發生的「區域整 合」與「全球化」的現象,不謀而和。此種由「區域整合」而衍生「跨國」或 「區域」憲政主義的發展趨勢,從歐洲聯盟或美洲統合的經驗中,最能清楚彰 顯。另一方面,轉型憲政主義的加速擴散,使二十一世紀的民主憲政國家的數 目之多,為十八世紀古典憲政主義萌芽之後所僅見,各國的憲政體制完整性與 憲法機能的高度活絡現象,更進一步促成各國積極進行相互間的憲法互動,催 化「跨國」、「區域」或「全球」憲政主義的發展。 前述區域整合與區域憲政主義的相互催化的趨勢,不僅發生在歐洲或美洲, 身處亞洲一份子的台灣,對於亞洲(尤其是東亞與東南亞國家)在一九九八年 亞洲經濟危機之後加速進行的「亞洲整合」(Asian Integration),以及此一亞洲整 合是否也會如歐洲、美洲的發展經驗一般,導致所謂「亞洲憲政主義」(Asian Constitutionalism)的產生,亦必須有所瞭解。此外,目前亞洲各國憲法的發展以 及其憲政機制的活絡程度,是否已經可能催化、甚至促成亞洲各國之「跨國」與「亞洲憲政主義」的萌芽?台灣的民主化與憲政成熟發展、中國法治主義的 發展情形,香港「基本法」體制運行的順暢、新加坡與馬來西亞的新威權憲政 主義(neo-authoritarian constitutionalism)等,對於亞洲經濟整合與政治發展會產生 如何之響? 本研究的目的,在於論述並架構「區域整合」與「跨國」或「區域」憲政主 義的理論關聯與制度條件,並掌握並分析「亞洲整合」的現況與趨勢,以預期 亞洲整合是否也會衍生「亞洲憲政主義」的產生。最後,本研究將對台灣面對 亞洲整合與亞洲憲政主義發展與萌芽所產生的全新憲法議題加以探討,提出初 步看法,並嘗試研擬因應策略。 Transitional constitutionalism, a byproduct of the third-wave democratization that occurred in the last decade of the twentieth century, has spread to both the regions and the world at an accelerating speed. Transnational, regional, or global constitutionalism has emerged, as a result. This trend in the development of world constitutionalism has coincided with regional integration and globalization that have appeared in the reshaped world of post-cold war and the Internet. Regional integrations such as European Union or Organization of American States and their constitutional consequences have best exemplified the intriguing relationship between regional integration and the developments of transnational or regional constitutionalism. Furthermore, because of the unprecedented expansion of transitional constitutionalism, the number of constitutional democracies has reached the highest peak ever since classical constitutionalism was developed in the eighteenth century. The exuberance of constitutional functions as well as solid constitutional structures in almost all national constitutions have channeled and made possible, the interactions of constitutions, thereby triggering the emergence of transnational, regional, or global constitutionalism. The intense interactions between regional integration and the developments of regional constitutionalism have not occurred only in Europe or in America. After the Asian economic crisis of 1998, Asian integration has been in sight. What will the consequences facing Taiwan as Asia integrates and how will Taiwan best respond to them? More importantly, will Asian integration lead to Asian constitutionalism, like Europe and America? If so, to what extent and in what ways can Asian constitutionalism burgeon and develop as Asia integrates economically, culturally, and politically? What effect will Taiwan’s vibrant democracy and solid constitutionalism, China’s early development in the rule of law, the uncertain status of the Basic Law in Hong Kong and its struggle with China, and so-called neo-authoritarian constitutionalism in Singapore and Malaysia have on the Asian economic integration and political development? This research project aims to study the intriguing relationship between regional integration and transnational constitutionalism and analyzes its theoretical foundations. The project also attempts to understand the current situation of Asian integration and its future and to project whether Asia integration will bring about Asian constitutionalism. Finally, this research will lay out some constitutional agendas for Taiwan as it is faced with economic and political consequences of Asian integration. |
