標題: | 台灣法學教育研究(1928-2000)—以台北帝大/台灣大學為例 | 作者: | 王泰升 | 關鍵字: | 台灣;法學教育;台北帝國大學;文政學部;政學科;台灣大學;法學院;法律學院;法律學系;教育政策;法學學術史;legal education;educational policy;legal profession;Taipei Imperial University;National Taiwan University;School of Law;Department of Law;academic history of law;Taiwan | 公開日期: | 2002 | 出版社: | 臺北市:國立臺灣大學法律學系暨研究所 | 摘要: | 近代西方法學教育自日本統治時代進入台灣。為探究西式法學教育移入台灣的歷程,本計畫 針對台北帝國大學文政學部政學科(今日之台灣大學法律學院)—創立於日治時期的台灣第 一所近代法學教育機構,回溯分析過去台灣法學教育發展上的學門學術累積與傳承情形,分 析其對當時與現今台灣社會立法、司法或法學發展等之影響。進而分析戰後,在另一個國家 不同教育政策下改制設立後的台灣大學法律學系(院),在教學與研究上跟過去之不同,以及 其對台灣社會政經社各方面之影響,與其發展迄今的改革聲浪。 換言之,本計畫以台灣大學法律學院過去之發展歷程為例,觀察一個原本欠缺法學教育機構 的傳統社會裏,法學教育機構與政治、社會變遷之間的互動關係。從國家政策及學制的角度 出發,闡明此一法學教育機構的定位與組織型態。繼之,由課程安排、授課教師之出身背景 及研究成果,探究其法學知識的性格。例如,是否以培養司法官僚為主、受否偏重某特定法 系?中、日、美、德等國的影響為何?此外,亦探討校園風氣及課外活動對於學生人格的培 養的作用。藉由對台大法律學門畢業生的就業分佈與各該部門(學術、立法、司法、行政、 司企業等)中,台大法律人所佔的比例,說明台大法律學院之實質影響力。最後,針對其歷 年來培養出之學生所撰寫之學士論文、博碩士論文等學位論文與教師學術著作等之質量與研 究方向上之變遷分析,做學術史層面之考察。當社會對今日之法學教育有不一樣的新期待時, 台大法律學院又是以何種方式回應?分析這種回應與其向來的教學研究傳統間之關係。並同 時參考學界既有,關於他國、他校法學教育的研究,以收比較之效。 The modern legal educational system was not introduced in Taiwan until Japanese colonial rule.The colonial government established the Taipei Imperial University as the highest educational and research institution in Taiwan.In the Taipei Imperial University,the College of Literature and Politics (文政學部)provided modern legal education in some degree. After World War II,Taipei Imperial University was succeeded by National Taiwan University.In a result,the highest legal education and research was developed in another way based on the policies of state.In the postwar period,Department of Law of NTU has worked some affection in social,political,and economic aspects. This project intends to explore the interrelationships between legal education institute and social,social changes in a society that traditionally did not have legal education institute.The case study focuses on the history of National Taiwan University College,School of Law.It will illuminate the status and organization of the legal educational institute in the perspective of the national policy and educational system.For instance,whether the legal education institute was influenced by a specific legal system?To what extent does Chinese,Japanese,American, and German law influence this School of Law?What impact does the campus environment and extra-curriculum have on students ’ characteristics?? In addition,this project will examine the careers of the graduates of this School of Law,thereby demonstrating the substantial influence of this School of Law.It will also examine the papers and thesis written by the graduates and the publications of the faculty member,so as to explore the academic quality and research tendency of this School of Law. |
