Abstract
In order to identify and connect between
computers in internet, each computer has a
certain Internet Protocol Address. Because
the IP Address is a series of numbers, it is not
easy to remember the number for human
beings, so it is transferred into alphabet,
which is called Domain Name. Users of
internet only need to key in the domain name
of a computer, which they want to connect,
they can reach the computer through the
internet immediately. The function of
identification and connection of domain
name is very important in internet.
The issues of the protection of domain
name Internet include mainly:
1. Is domain name a kind of name in
civil law? Can the holder of a name,
especially a firm name, bring an action of
damages against the person who use and
register the same name as a domain name? 2. How about the relationship between
the domain name and the trade mark? This is
a question which is warmly discussed
recently in many countries.
3. Does unfair competition law protect
domain name? If someone register a domain
name with a name or trade mark which
belongs to someone else, can the rigistration
be prohibited?
Above all are the basic and most
important issues by the protection of domain
name. This project will focus on these issues,
study some important cases occurred in
different countries and provide some
suggestion finally.
