Abstract
Subcontract trade means the trade by contract between prime business concern and contracting business concern. The characteristic of subcontract trade is that it is organizational and continual and cooperative. Japanese and Korean governments have strategy to develop subcontract trade which is expected to bring prosperity on middle and small size business as well as large business, and deepen industrial structure. But basically subcontract trade has a problem. That is; unfair trade activities happen because of unequal status between parts concerns. Therefore, Japanese government enacted the “Fair Subcontract Trade Act” in 1956 and Korean government enacted the “Fair Subcontract Trade Act” in 1984 to regulate unfair subcontract trade activity of a prime business concern. But at the beginning, most middle and small size business are afraid of loosing trade relationships, so they do not accuse. Their governments have tried to make better the “Fair Subcontract Trade Act” for over twenty years. The aim of this thesis is that; the first thing is sharing Japanese and Korean’s experience in the “Fair Subcontract Trade Act” with Taiwan. The second one is making a comparative study of Japan and Korea. The last one is explain why Taiwan need this kind of law.
