Abstract
The interest of this dissertation is about the criminal law’s estimation model on liability, of patients with mental disorders or diseases, to take guilt, including estimation on abilities of patients with personality disorders, which are always regarded as full ability criminals by practice of our nation’s jurisdiction. In second chapter, the text will briefly introduce theories of guilt in European-land law style and the choices of judgment practice and scholars in our nation. And also, try to bring up a new expound of justice and guilt theory of criminal law by systematic theory. Text will summary the estimation model in chapter three and try to exam estimation model practice of our nation’s jurisdiction by psychiatry diagnosis models. In chapter four, text will focus on the history and diagnosis models of personality disorders. Also, introduce personality theories of psychology. Text will try to find out what kinds of illicit behavior are easily committed by patients of personality disorders, discuss that can consider personality disorders as one kind of biological element of demurrers against liability of crimes, and read supreme court’s opinion about personality disorders in the past. Text brings up a new viewpoint about free will by systematic theory and reflection on criminal policies about patients of personality disorders.
