Abstract
Concerning the urgent needs of LTC, the Taiwan government decides to found LTC Insurance. As a result, now the LTC Insurance Act and the LTC Services Act are already in the stage of legislation. To develop the LTC Insurance in Taiwan, the collaboration and the perfection of the dual acts should be taken into consideration. From the LTC Insurance itself, including the issues of related Subjects, financial and payment system, to the Quality assurance and the protection of those who needs LTC services, Quality assurance is especially the important topic to cohere the dual acts.
Besides, this thesis also concerns on the role of the government in the LTC system in Taiwan, considering that the position of the state will affect the content of the dual acts. In Taiwan, not the government of Taiwan but the private sectors serve as the main provider of LTC services. Comparing that the Taiwan government get involves too much in other social insurance, it deserves much to discuss, what is the role of the state in the future LTC insurance system in Taiwan.
Germany shares similar backgrounds with Taiwan in the development of LTC. They found and operate the LTC insurance on the basis of social autonomy. Instead standing as the provider of LTC services, Germany choose to collaborate with private sectors. But, under the principle of the social state and the obligation of protecting citizens, the state still has to impose regulations to ensure the quality of the payment of LTC insurance according to the needs of the people. Taking Germany as an example, we examine what the role of government is and how to perfect the contents of the dual acts in Taiwan.
