Abstract
With the warm cross-strait exchanges, personnel exchanges become more frequent. In view of the special cross-strait relations, the government control of civil servants to Mainland China regulations, to the academic and practical concern. On this subject, not only the people involved in the constitutional guarantee of the basic right to freedom of movement, but also related to the relationship between civil servants and the State.n this paper, the view of constitutional law, in the comparative study, through the relevant principles testing whether the study of free movement, the rule of law in different countries and mode of control, and review of free movement of the Standards of Judicial Review standard. Then, point out that Taiwan''s control of the gap between norms and reality. At the same time, think about how to ensure national security and response to the strong demand of specific aspects of exchange, for a set of constitutional norms of control and put forward solutions and recommendations providing to relevant units reference.
