Abstract
China''s current "The People''s Republic of China Law on Mediation and Arbitration of Labor Disputes" ("The labor dispute mediation and arbitration law" for short) was adopted at the 31st Session of the Standing Committee of the 10th National People''s Congress on December 29, 2007. Its spirit, idea and basic system are a major reform and innovation. It basically adapts to the market economy under the condition of excess labor dispute, handling requirements and the building of harmonious labor relations.
The labor dispute mediation and arbitration law has been made in the light of the specific conditions of economic and social development,while adhering to the principles of labor law and summing up the experience from the practice of handling a labor dispute. The law can encourage grass-roots organizations to handle the labor dispute and further improve the system for handling.
The thesis topic is "The Study of "The People''s Republic of China Law on Mediation and Arbitration of Labor Disputes", including The Impact on Taiwaness Businessmen''s Enterprise Management". First, this research attempts to precisely review China’s labor dispute resolution system from the perspectives of China’s legal system. Secondly, this thesis will also discuss the impact on Taiwaness businessmen’s enterprise management and observe Taiwaness Businessmen labor dispute through some case studies. At last, we will discuss and give some positive suggestion about how to handle and prevent Taiwaness businessmen’s labor dispute problems in the future.
