Abstract
This study aims to examine the criteria for determining criminal responsibility in cases involving intoxication and alcohol addiction from the perspective of health inequity. Alcohol addiction has become a significant global public health issue, impacting not only individual health but also societal problems, particularly criminal behavior. Current legal systems often overemphasize personal responsibility when dealing with cases involving intoxicated or alcohol-addicted individuals, neglecting the profound influence of social determinants such as socioeconomic status, education level, and living environment on individual behavior. Health inequity theory emphasizes that an individual's health status is not solely determined by personal choices but is influenced by multiple social factors. Therefore, this research will explore how to fairly treat these groups within the legal framework, promoting more reasonable judicial decisions and social policy reforms.
