Abstract
Newly-developed telecommunication technology brings about plurality, complexity and convenience in providing audiovisual services, making audiovisual sector one of most heavily influenced sectors in WTO by digital convergence. Thus, how WTO regulations apply to this sector remains to be clarified. Moreover, digital convergence exemplifies the conflict between cultural values and trade interest. An immediate solution is indeed in need.
This thesis aims at seeking the solution by following steps. It begins with the definition of audiovisual services and its relation with culture. Then, it introduces the concept of digital convergence, explores its impact on audiovisual services, specifies the problems and indicates how to deal with those problems in principle. In order to clarify the scope of audiovisual commitments, it tries to answer “who” should be regulated, “what” regulations should be applied, and “how” they should be applied. Nevertheless, those regulations should ensure Members’ right to adopt measures for cultural protection while requires appropriate standards of review to prevent from abuse. Finally, a proposed approach of reformation is provided.
