Abstract
Adoption,is our existing system,But we have different comment in the past and present by the Changes of the values and human rights,
After sixty years of separation between the two sides,What is the problem of adoption between the two sides is the point of this paper,the point of study is come from the familiar with adoption laws and the Practical experience,Through practical discussion View the provisions of existing laws and the mainland areas of adoption, may the adoptee''s interests able to meet the people on both sides of adoption.Especially in mainland China adopted minor child,The subtitle ofthis thesis～The example of People in Taiwan adoption mainland minors.
I’m so Lucky and honored,Able to personally participate in the substantive work of the Court of adoption，therefore,Continental adoption practices for understanding, Can be more profound of in contact with advanced adoptions involving land matters,Because personally involved in adoption practice, to have access toup to adoption in formation,It’s helpful for the thesis of brewing and ripening.
In this paper:Study of Literature, through various literature, Comprehensive understanding of experts and scholars studied the core issues opinions and views.An Empirical Study,According to existing regulations:the way of oprationon the court and conclusions,according to empirical and discussing the inadequacies and flaws of law and cause difficulties on the practical application and to ldentify the possibilities and directions of regulations, practices adjustment,Case study:The paper will review the reasons for the Court''s conclusion in each case applicable law or discomfort law,and by observing the applicable laws of each case then cumulative data to determine common or most practical conclusions and positions,it’s the core of this paper studies.Functional Analysis:By analysis of our current legal adoption,Understanding the legal adoption of land-related design and practical function,How to create conflicts and legal difficulties involved in adoption.Finally,summarize the results of the method of analysis,On the plight of the Court of adoption practices involving land,Explain the plight of administrative units,Court faced adoption events involving land,Legal interpretation that can be taken and legal amendments,As at the end of this paper.
