民法上出版契約之研究

This project focues on the contract of
publication. According to article 515 Civil
Law, the object matter of the contract of
publication is work, which is protected by
Copyright Law. Not only Civil Law, but also
Copyright Law, are important for the contract of publication. The issues of the contract of publication include mainly: 1. What is copyright? How about the
relationship between the Civil Law and the Copyright Law? 2. How about the legal relationship between the authors and the publisher? How
about the rights and obligations of the
authors? How about the rights and
obligations of the publisher? How about the
liabilities when one of the parties violates the
contract?
3. What will be the effects of the recent
amendment of Civil Law on the contract of
publication?
Above all are the basic and most
important issues by the contract of
publication. This project focuses on these
issues, studies some important cases occurred
in Taiwan and provide some suggestion
finally.
