Abstract
As the soul of the criminal procedure, the exclusionary rule has been researched for many years. But in cross-border cases, it has not been discussed yet, especially in Taiwan. To solve the problem, this article would like to refer to the experience of Germany. Because almost the whole law system of Taiwan originated from Germany, and also there are tons of Germany literature on the subject. The opinions of European Court of Human Rights also deserve to be mentioned because of the transnational Law.
