Abstract
The retention or abolition of the private prosecution has been discussed over the past few years. Not only scholars but also judicial officials tend to hold negative impression toward the existing of the private prosecution. But when we look back to the history in Republican China, we can find that people preferred the private prosecution to public prosecution. How does this change happened may be important to the dispute of the status of the private prosecution. Therefore, in this thesis, I intended to focus on the heritage of western-style prosecution system as well as the adoption and development of the private prosecution. Realizing the private prosecution in its historical context would be helpful to make a decision about its future.
