Abstract:
The debate over patents, pharmaceuticals and affordable access to health care for all is increasingly in these years, particularly when the worldwide attention focuses on the growing HIV/AIDS and SARS crisis. Patents perform an essential role in stimulating the development of new drugs and medical products, by offering incentives for investing in expensive and long-term research. Without patents, existing pharmaceuticals would not have been produced, new and better pharmaceuticals needed to overcome the diseases and infection would not be developed. However, the tendency of expansion of patent rights in the fields of biotechnology and pharmaceuticals seems to impede the access of essential drugs and medical treatment and affects adversely the public health. For these reasons, the most important issue in these years is getting balance of the patent protection and limitation of patent rights in biotechnology and pharmaceutical industries.
