Abstract
Recently, the social movements are growing in Taiwan. The essential cause is about Taiwan Government’s economic policy and duty of supervise. However, the legal system in Taiwan can’t aware this situation, even if they aware, they still don’t have useful ways to solve this problem. Either arrest the people protested, or allow them to break the law. Arrest the people will bring more protest movements, and allow the break-law moves will effect social order. Therefore, the legal system is facing it’s difficult position. The research try to use Luhmann’s social system theory to re-entry the legal system’s observation and the concept of Zumutbarkeit, hoping to find a better way to solve the problem mentioned.
