Abstract
This essay is a study of variety treatment in juvenile system. The variety treatment comes from America juvenile system. It describes the history of America juvenile system in Chapter 2. The most important thing in America juvenile system is the development of Youth Court in Chicago in 1899. The trend of thought in that age is that criminal is a kind of sick; the law system should treat them by medical mode. The whole environment of the criminal policy is focus on the welfare and correction. The Youth Court is exactly based on them and develops the Thought of Parens patriae.
But after 1960s, the America society had give up the policy of the correction and become tough to the juvenile. The reason of the change is the failure of correction and the budget is short. Without youth school, the other treatment get more attention than before. The treatment become small scale and can be combined which first start in Massachusetts.
The chapter 3 is focus on the content of the treatments. Although there are a lot of treatments, there isn’t any efficient statics of the variety treatment in juvenile system. In the study such as criminology, Durkheim, Risk Society and Foucault, the variety treatment seems like fake policy, is a kind of policy to stable the order of the society.
Although the variety treatment is view as a method of society control, there are lots of difference between Taiwan and America. In spite of the juvenile is original in America, the juvenile in Taiwan doesn’t have the part of juvenile welfare. The juvenile system is like criminal law in Taiwan. Maybe the tough treatment can be view as welfare part in Taiwan and will inspire the welfare part in juvenile system. But, the juvenile system in Taiwan has its own questions. These questions also should be considered. To sum up, I think maybe we can introduce some treatment into the juvenile system in Taiwan for affirm the spiritual of the original juvenile law.
