Abstract
本論文將日據時期施行於台灣的『台灣都市計畫令』，與在當時同樣是日本殖民地的朝鮮、關東州所施行的『朝鮮市街地計畫令』、『關東州州計畫令』，以及日本國內的『都市計畫法』等作逐條的比較，試圖找出『台灣都市計畫令』之法令特徵。以結果而言，得到下列的結論。從稅收、都市計畫事業、既成道路的認定、指定俱偏見性的特別地區、區劃整理的實施者之認定等等的層面看來，與其他的類似法令比較起來都要嚴格得多。日本國內之都市計畫委員會可協議決定都市計畫、都市計畫事業以及每年度應該執行的都市計畫專業，但台灣的都市計畫委員會卻單純只是純粹的諮詢機關。類似日本的土地徵收使用委員會的組織之權限與機能，在台灣則全由台灣總督一手所承覽。而『台灣都市計畫令』是台灣多次實施市區改正之後才被制定的法令，在該計畫令制定之前，台灣總督或日本人地方官僚任意地，若認為台灣都市有「必要」施行市區改正，就去執行市區改正，頂多頒布了一些片斷式的規則條文，從計畫令與市區改正實施之時間先後，可知該計畫令與當時的市區改正並無直接的關係。
It is often said that the eown planning and zoning ordinance of Taiwan was advanced even to be comparable with Japan's before World War II. Making a comparative stuby among Japan, Korea, Taiwan and Kwantung Leased Territory, following results were obtained. First, the advanced, mordonized ordinance of Taiwan had nothing to do with town planning undertaking, which had been finished nearly before promulation. Second, from the viewpoint of the urban planning taxes, decisive power, sanction of built-up road, distinction of specitying zoning, that ordinance was considered inferior to evenkorea's, also under the colonial ordinance of Japan.
