Abstract
本文的主要目的是，是就目前聯合國正在談判之「國家管轄外區域海洋生
物多樣性養護與永續利用協定」（Agreement under the United Nations Convention
on the Law of the Sea on the Conservation and Sustainable Use of Marine Biological
Diversity of Areas beyond National Jurisdiction）中，有關「以區域為基礎之管理
工具」（Area-Based Management Tools，對沿岸國國家管轄內區域之管轄權影響
與其可能的調和方式進行分析。在文章中，作者透過對東北大西洋海洋環境保
護公約（the Convention for the Protection of the Marine Environment of the North-
East Atlantic）實踐之觀察，認為國際法上之「鄰接性」、「連續性」、「相容性」、
與「適當顧及」等原則，認為這是調和此一新協定與沿岸國海域管轄權間可能
的法律基礎。
