Abstract
This article explores the conflicts between F/OSS and intellectual property law.
After 20 yesrs, F/OSS movement succesed to popularity of the general public, and create considerable commercial interests in the meantime. Meanwhile, F/OSS litigation is gradually increased. Whether these legal problems hinder the pace of F/OSS movement, or help to clarify the conflict between F/OSS movement and IP law, that make F/OSS movement gained new energy?
First, we will analyze Oracle America Inc.v.Google Inc. to find the conflict. Second, F/OSS communities or companies which using FOSS try some ways to decrease the intellectual property legal risk. This article will respectively, to assess its effectiveness. Finally, by discussing the case process and results, try to reasoning the effects to F/OSS community and F/OSS movement.
