Abstract
建築物屬於公共藝術之一環，無聲無息地與世世代代的大眾交流著；建築被譽為顛峰性的藝術成就，以藝術人文促動人類心靈感動，以科學技術照料人類庇護需求。著作權法的傳統公益思想包括知識自由流通、文化永續發展以及保護創意等，第四十四條以下著作權行使之限制，應符合憲法第二十三條對於人民權利限制之規定。公共建築與民間一般建築有別，尤以公益上之考量為甚，現行著作權法在此議題並未刻意加以分別隸屬，實則公共建築有關公益部分已受政府採購法規範，對於與公益無關的束縛對國家的發展其實極為不利。公務人員依法行政，在國庫行為上從嚴解釋，有時反而不利的是國家全體。政府採購在著作權方面自應以專屬之著作權法為依歸，不必然要在政府採購法及相關契約條款下大費周章，甚或抵觸專法或民法強制性規定之可能。因此，本文提出一些建議供著作權法修法之參考。

The idea of the public service on traditional thinking of the Copyright Law, including intellectual free exchange of cultural sustainable development and protection of creative, the restrictions under Article 44 of Copyright Law shall comply with the provisions of Article 23 of the Constitution. The public works and private building is dissimilar, especially the consideration is more obvious in the public welfare nature, the Copyright Law explicitly not to separate the management in this part, but in fact the public building handles had limit of the Government Procurement Law, a large bound is extremely unfavorable to the development of the country. The government workers in accordance with the law work to strengthen restrictions on public affairs decision-making, sometimes it does not meet the general interest of the country. In the aspect of Government Procurement, the copyright aspect should take the exclusive Copyright Law as the basis, is not necessary under the terms of the Government Procurement Law and related contract provides to avoid conflict with the specialized laws. Therefore, the proposed recommendations refer to as Copyrights reference.
