Abstract
In debt discharge procedure, restrictions
vary in degree should be imposed on the
exercise and content of the mortgage in
accordance with the difference between the
procedural objectives of rehabilitation or
liquidation. This is to harmonize the two
basic requirements of a fair bebt claim
system and debt collection assurance of the
security system, so as to take into account the
mutual benefits of the ordinary creditor and mortgager.
