Abstract
The criminal law strictly protects the right to say “no” to sex, while entirely denies the right to say “yes” to sex, for example, the right to access pornography or to exhibit sex in public. The sense of shame potentially dominates people’s thought and judgment about sex. However, shame never becomes the focus when people judge sexual regulation in criminal law. The author of this article attempts to analyze the essence and the social meaning of shame, and to reconsider the proper role it should play in criminal law.
