謝銘洋2006-07-252018-07-052006-07-252018-07-051999http://ntur.lib.ntu.edu.tw//handle/246246/12774網際網路上的每一部電腦都有一個特 定之位址（Internet Protocol Address ），此 一位址之作用在於讓網際網路上之電腦彼 此之間得以互相辨識、連繫，由於其係由 四組數字所組成，人類並不容易記憶，網 域名稱（Domain Names ）則是將此一讓電 腦辨識之位址轉換成讓人類得以辨識並便 於記憶的字母，因此使用者只要將其所記 得的網域名稱鍵入電腦，就能透過網際網 路很快地連接到其所欲前往的網站。由於 網域名稱具有此種標示之作用，因此在網際網路上愈來愈受到重視。有鑒於網域名稱在網路運用上之重要 性，本研究計劃擬對於網域名稱在法律上 所受之保護，從各方面深入加以研究。 首先探究者為網域名稱與事業名稱之 關係如何，網域名稱是否屬於民法上姓名 權保護之範圍？如果事業名稱被他人擅自 搶先登錄，是否會構成姓名權之侵害？ 其次應進一步探討者為，網域名稱與 商標之間的關係如何，此為一受到討論最 多的問題。將自己的商標使用於網域名稱 上，是否算是商標的使用？他人擅自以著 名公司之商標搶先登錄，是否會構成商標 權之侵害？相同之商標被數不同之事業， 分別註冊使用於不同之商品或服務上，誰 有權將該商標申請登錄為網域名稱？數個 不同事業，分別於不同之國家以相同之商 標，註冊使用於相同或不同之商品或服務 上，誰有將該商標登錄為網域名稱之權利 ？是否可以用商品名稱或描述性之文字登錄為網域名稱？最後，網域名稱是否可以成為不正競 爭法之保護客體？事業名稱或商標被他人擅自搶先登錄為網域名稱，可否禁止之？ 以上問題，都是網域名稱最容易面臨 之問題，本研究計劃除先從技術面對於網 域名稱之作用與取得加以探討，以了解網 域名稱之性質外，並將進一步藉著對國內 外相關案例與學術討論之研究，對於網域 名稱在各種不同之法律上之地位以及上述 諸問題深入研究分析，並探討國際上就上 述問題之解決途徑，最後則提出具體之建 議以作為我國法院適用法律及未來修法上 之參考。In order to identify and connect between computers in internet, each computer has a certain Internet Protocol Address. Because the IP Address is a series of numbers, it is not easy to remember the number for human beings, so it is transferred into alphabet, which is called Domain Name. Users of internet only need to key in the domain name of a computer, which they want to connect, they can reach the computer through the internet immediately. The function of identification and connection of domain name is very important in internet. The issues of the protection of domain name Internet include mainly: 1. Is domain name a kind of name in civil law? Can the holder of a name, especially a firm name, bring an action of damages against the person who use and register the same name as a domain name? 2. How about the relationship between the domain name and the trade mark? This is a question which is warmly discussed recently in many countries. 3. Does unfair competition law protect domain name? If someone register a domain name with a name or trade mark which belongs to someone else, can the rigistration be prohibited? Above all are the basic and most important issues by the protection of domain name.
