2011-11-112024-05-14https://scholars.lib.ntu.edu.tw/handle/123456789/660682摘要：本研究計畫為協助司法院建構我國新近大幅修正「冤獄賠償法」後而公布施行之「刑事補償法」司法智識庫為計畫目標，結合相關法條、有參考價值之精選裁判等各種資訊，彼此互相串連，以協助法官更有效率的取用所需資訊，提高辦案績效。具體計畫內容包括整合新公布施行之刑事補償法條文，比較刑事補償法（新法）與冤獄賠償法（舊法）相關條文規範內涵之異同，並進而在此一基礎上，蒐集、整編並評釋具參考價值之實務判決，建構關鍵詞與重要精選法學論著，與撰寫相關法學意見等為主。<br> Abstract: This research aims to assist Judicial Yuan in constructing Law and Regulations Retrieving System for the broad amendment of “Law of Compensation for Wrongful Detentions and Executions,” combining related articles, select judgments with reference value, varied information, etc. so that judges could get materials they need efficiently and improve their case achievements. The concrete content of this research includes studying the latest version of Law of Compensation for Wrongful Detentions and Executions, comparing the latest version with the old one, and finding similarities and dissimilarities of both, which the further work of collecting, organizing, and commenting the practical judgments with reference value is based on.
