2014-03-242024-05-15https://scholars.lib.ntu.edu.tw/handle/123456789/663296摘要:本計畫目的係為充分掌握世界衛生組織菸草控制框架公約(Framework Convention on Tobacco Control,以下簡稱FCTC)之最新規範發展,並協助政府單位研析菸害防制相關法律議題。略述如下: (一) 蒐集締約方會議之最新資訊與研擬參與之策略 FCTC第五次締約方會議 (Conference of Parties, 簡稱COP) 已於2012年11月12-17日於韓國首爾舉行。本計畫將依據參與COP5所獲致的會議成果及資訊,爭取參與2014年在俄羅斯舉辦之COP6會議。藉由參加國際會議,了解與學習國際間對菸害防制所作之努力與規範發展。 (二) 針對FCTC各項議題進行相關研究分析、研討會或教育訓練 本計畫以研究FCTC執行現況,並分析其主要議題為目標。包含菸稅課徵相關議題、電子菸及無煙菸品研究、教育訓練及公眾認知,以及減少菸草需求等重點議題,組成工作小組進行討論研究。本計畫亦將針對FCTC最新議題舉辦國際學術研討會,與國際間專家學者進行交流,並提升我國國際衛生相關學術水準。另將針對FCTC重要議題設計專業性訓練課程,培植我國相關人員國際衛生法律專業知識及對於FCTC議題的瞭解。 (三) 針對FCTC相關議定書或準則提供諮詢或建議 本計畫將針對第六次締約方會議可能討論的重點議題進行研析,並轉化為國際文件,作為未來參與會議之重要依據。另外,為順利推動我國菸害防制工作,並與國際規範接軌,本計畫亦將深入探討我國菸害防制法規與FCTC間之異同,提出對政策建議,協助政府未來對相關議題之因應。 <br> Abstract: This project purports to study and follow up the latest development of WHO’s Framework Convention on Tobacco Control (hereinafter FCTC) as well as to assist the government in dealing with related legal issues. The content of this project includes the following: 1. Updating Information on the Conference of Parties and Analyzing Participation Strategy The FCTC Fifth Session of the Conference of the Parties (hereinafter COP) took place in South Korea during the period between 12 November 2012 and 17 November 2012. On the basis of the experience obtained from COP5, this project will continue to explore the possible avenues to participate in the 2014 COP6 to be held in Russia. By this means, it is expected that current endeavors and the new development of tobacco control made by the international communities can be better understood. 2. Studying Relevant FCTC Issues, Holding International Conference and Offering Educational Training Courses This project will conduct studies on the implementation of the FCTC and analyze the relevant issues. Among these, tobacco tax, smokeless cigarette and e-cigarette, educational training and promotion of public awareness, tobacco dependence and cessation are notable topics. Furthermore, by holding the international conference on FCTC, this project will invite the participation of well-known international experts with the expectation to enhance the domestic level of public health professionals. Also, a series of well-designed professional training courses regarding FCTC will be offered in order to help health professionals better understand the development of international health law and as FCTC. 3. Providing Recommendations on FCTC Protocols and Guidelines This project will analyze important topics which are likely to be covered in coming COP6. Based on the result of such analysis, this project will further forward and distribute an international document as a contribution to more discussions. Moreover, in order to effectively promote the tobacco hazards prevention in Taiwan and connecting the level of tobacco control regulation with international trend, this project will explore the similarities and differences between the “Tobacco Hazard Prevention Act” and FCTC.
