2007-08-012024-05-17https://scholars.lib.ntu.edu.tw/handle/123456789/688122摘要：勞動基準法註釋整合型計畫-工作規則暨勞動保護子計畫 勞動法在體系上可區分為個別勞動法與集體勞動法，1984年施行之勞動基準法是我國個別勞動法之核心所在，對於我國勞工而言也是最重要的勞工法令。因此，近二十年來有關勞動法之書籍多將焦點鎖定勞動基準法。不過，「勞動基準法註釋書」在我國則尚未問世。相對於「註釋書」在德國或日本對於勞動法學研究以及勞動法實務佔有極其重要之地位，在我國出版一本兼顧理論與實務之勞動基準法註釋書，實有急切之必要性。 本整合型計畫之研究將以歐陸國家之註釋書形式為標準，以勞動基準法之法律內容為研究範圍，將進行三年期的研究，希望針對勞動基準法及相關的個別勞動法問題，論述與寫作出進步的註釋書格式，以提升國內勞動法學之研究水準，提供勞動領域中之社會成員之運用。而本研究「勞動基準法註釋整合型計畫-工作規則暨勞動保護子計畫」則為上述計畫之子計畫，主要針對勞動保護法令之核心，亦即女工、童工、技術生、工作規則等法條做註釋，並在註釋中兼顧相關法令之規定，如兩性工作平等法與相關子法、職業訓練法與相關子法、以及身心障礙者、中高齡、原住民等特殊勞工之法令規定與理論。 <br> Abstract: Commentary on Labor Standards Act - Work Rules and Labor Protection Subproject The Labor Standards Act is the most important regulation in the labor life of Taiwan, but also as the centre within the individual labor law. This integral research project put the formation of continental-European so-called commentary as its ruler, set contents of the Labor Standards Act as its research objects, attempts to found and write a progressive formation of such kind of commentary. This project may improve the scientific level of research on labor law and in the meantime offer practical help for using from the social members in Taiwan.
