2011-08-012024-05-17https://scholars.lib.ntu.edu.tw/handle/123456789/680677摘要:在現代社會中,法院受民眾信賴以及司法功能的充分發揮,往往是社會經濟發展的基礎,也是多元社會和諧安定的重要社會資本。東亞國家不論在社會多元、政治民主化或經濟發展程度上都有高度的歧異,但對於現代化法院的建立與功能的發揮,則是各國共同的需求。在東亞跨國投資,產業、技術、資金與人才流動日益頻繁的今日,掌握東亞國家法院的形貌與功能,具有實務與學術上的重要性。 法院的形貌、功能定位與運作程序,往往反應國家的法治傳統、社會結構與發展動態。東亞國家的法院的組織運作與所適用的法律規範,往往反應法律繼受與在地發展的辯證,形成東亞特有的法院觀與法律文化。東亞國家除了在近代各自以不同的方式與程度繼受西方的法律制度與規範外,近來東亞法院相互援引判決以及法官之間或法院之間形成頻繁對話的情境,也形成了司法區域整合的現象,更值得重視。 東亞法院之間如何互動與相互影響,對於東亞民主理念與法治主義的發展,具有學理上的重要意義。本研究希望結合多位不同法學領域的學者,以法院功能的演變與發展為經,以法律的繼受與發展為緯,以法院的功能為核心,共同探討東亞的司法實踐與理論發展,並進一步掌握台灣法院與法文化在東亞的網絡定位。 本研究的研究範疇除了台灣以外,包括韓國、日本、中國(包括香港)、新加坡、泰國、馬來西亞與越南等,涵蓋具有代表性的法律繼受背景、政治社會結構、發展型態的國家,在議題內涵上則以法院與法律的社會承擔、民間信賴、正義實現效能、以及國際化為重點。 <br> Abstract: In modern societies, a well functioning court system with civil trust serves the foundation of economic development and social integration as well. East Asian countries vary in social structure, political system and level of economic development, but the establishment of a well functioning judicial system has been recognized as a common infrastructure for sustainable development. The organization, procedure, function and operation of courts in East Asia reflect divergent legal tradition, social structure and developmental status in the region. Moreover, the operation of courts in East Asia, particular how they apply laws and modes of reasoning bear the dialectics of legal transplant and indigenous development against the backdrops of colonial legal establishments as reflected in the region. Therefore, a unique legal culture and function of courts have emerged for legal academic scholarship in the region and beyond. With the trend of transnational judicial dialogue, courts in East Asia begin to cite or appeal to decisions and opinions of other courts, forming an East Asian judicial network against the backdrops of increasing economic and social ties in the region. The interaction and dialogue of East Asian courts impact greatly on the development of East Asian legal development. This research will inquire into the development and transformation of courts’ function in East Asia in the context of reception of modern legal system from Western countries and the emergence of East Asia judicial network. This research will first depicts the judicial practices and then propose theoretical models for East Asian courts. In addition to a comprehensive study of East Asian courts, this research will attempt to clarify how Taiwan’s courts and legal culture interact with the East Asian judicial network. This research covers Taiwan, South Korea, Japan, China (including Hong Kong), Singapore, Thailand, Malaysia and Vietnam.
