2020-05-162024-05-14https://scholars.lib.ntu.edu.tw/handle/123456789/660683摘要：從民國101年起，司法院舉辦數十次人民參與審判模擬法庭，並於模擬法庭後舉辦研討會了解參與國民的意見，也對未參與之一般國民與國民法官進行對參審制的民意調查。惟，一直都未以心理學的角度了解在人民參審制的法庭中，職業法官與國民法官在互動的過程中，有哪些因素會影響兩種法官的判斷。本研究欲研究的標的可分為職業法官對國民法官的影響，國民法官對職業法官的影響，甚至國民法官之間的影響。本研究將採用觀察編碼法（observational coding），透過觀看模擬法庭的影片，以編碼系統性記錄並分類國民法官與職業法官的言語行為及非言語行為，再以統計方法分析法官的言語行為及非言語行為與判決結果的相關性。 <br> Abstract: Since 2012, the Judicial Yuan has conducted dozens of mock trials involving citizen judges, as well as conferences aimed at understanding citizen judges’ perspectives. However, these efforts have yet to include a psychological perspective that could help gain an understanding about the psychological factors during interactions between professional and citizen judges that might influence their judgment. The present research aims to examine possible bi-directional influences between professional and citizen judges via observational coding of video recordings of previously held mock trials.
