2016-02-252024-05-18https://scholars.lib.ntu.edu.tw/handle/123456789/701952摘要:菸品消費與菸害引起人類死亡、疾病與失能。全球計有十三億吸菸人口,每年有約五百萬人死於菸品所致之相關疾病。據估計,假設現行狀況未改善,2020年全球菸害疾病死亡人數將增至每年一千萬人。世界衛生組織 (World Health Organization, WHO) 爰於2005年通過「菸草控制框架公約」(Framework Convention on Tobacco Control,簡稱FCTC),以因應菸害全球化問題,目前計有180締約方。我國除向國際社會表達落實菸害防制及遵守FCTC之決心外,總統業於2005年3月30日批准簽署該公約之加入書。因此,了解並掌握FCTC議定書與準則之發展以及各國規範方向,對我國菸品控制政策之研擬與執行具有其重要性。 本年度計畫內容略述如下: (一) 針對電子煙管制規範、FCTC國內法秩序定位以及第七次締約方會議相關議題進行研究 1. 電子煙管制 本計畫將將以過往研究成果為基礎,繼續研究加拿大、紐西蘭、新加坡等國有關電子煙管制制度,並更新英國與美國相關實務之發展資訊。 2. FCTC於國內法秩序之定位 我國立法院於2005年通過FCTC,總統並於同年批准加入書,外交部並透過友邦遞交我國加入書進行存放,惟聯合國並未正式答覆。本計畫將研究FCTC於我國法秩序下之定位、FCTC第5.3條準則之地位以及訂定施行法之可行性相關問題 3. 第七次締約方會議相關議題 本計畫將研究COP 7相關議題、我國執行FCTC 第5.3條之經驗以及FCTC與經貿體制不一致性等問題。 (二) 開設教育訓練、提供菸品管制相關議題最新資訊及法律諮詢意見 教育訓練課程主題包括FCTC 綜覽、FCTC 第 5.3 條及指導準則、FCTC與經貿法律關係、菸品非法貿易議定書與電子煙等。本計畫另將定期蒐集國內外菸害防制法規發展資訊,並提供法律諮詢意見。 <br> Abstract: Death, disease and disability can be attributed to tobacco consumption. The global smoking population is 1.3 billion, among them, 5 million die a year due to smoking related disease, and the number is predicted to reach10 million in 2020. In 2005, the World Health Organization (hereinafter “WHO”) adopted its Framework Convention on Tobacco Control (hereinafter “FCTC”) in order to address the global tobacco issue. Taiwan has showed her determination to implement FCTC through the issuance of instrument of accession to the FCTC and successive efforts in tobacco control. A follow-up study on the latest development of FCTC and regulations and practices in other countries would be of value and importance to advance tobacco control policy in Taiwan. The research project includes the following topics and items: 1. Researches on E-cigarettes, FCTC’s Legal Status in Taiwan and COP7-related Issues A. E-cigarettes Based on the previous research, the project will continue to study E-cigarettes regulations in Canada, New Zealand, Singapore and new development of regulations in the U.K. and the U.S. B. Legal Status of FCTC in Taiwan Historically, FCTC was approved by Legislative Yuan and the instrument of Accession was issued by President Chen Shui-bian in 2005. However, UN has not permitted the deposit of Taiwan`s Instrument of Accession to the FCTC. This process raises an issue of the legal status of the FCTC in Taiwan legal order. The project will study the legal status of FCTC and its Article 5.3 Guidelines and the issue of adopting an implementation act for the FCTC. C. COP 7 Issues FCTC COP7 is to be held in India in November 2016. The project will examine potential discussion points in the COP7. Taiwan’s experience in implementing FCTC and the inconsistency between the FCTC and trade regime will also be explored. 2. Provisions of Education Training, Latest Tobacco Control News and Advisory Legal Opinions The project will provide education training courses. Proposed topics include an Overview on FCTC, Guidelines for Implementation of Article 5.3 of the FCTC, FCTC and Trade/Investment Law, Protocol to Eliminate Illicit Trade in Tobacco Product and E-cigarettes.
