臺灣大學: 法律學研究所王能君彭志崴Peng, Chih-WeiChih-WeiPeng2013-03-212018-07-052013-03-212018-07-052012http://ntur.lib.ntu.edu.tw//handle/246246/249755本文主要探究勞動派遣中的雇用安定問題,並將雇用安定分為常時雇用勞工之雇用安定與派遣勞工之雇用安定兩個層次,藉由日本勞動派遣法立法至今的政策演變,分別加以探討。 探討過程中,乃是將日本勞動派遣法立法與修正的時間,分為三個時期,分別整理各該時期在上開兩個雇用安定層次上具體制度的設計,爾後從其演變之中得出結論,即應以派遣勞工雇用安定作為勞動派遣雇用安定下的核心。最後提出派遣勞工雇用安定之保障的具體方向,應以派遣勞動契約存續期間雇用安定保障為最優位的核心,而勞動派遣的使用範圍限制則是在雇用安定與勞動條件保障不足時不得已的選擇。This thesis focus on the working stability of dispatched employment,and separate the working stability to two directions ,which are belong to typical labor and dispatched employment labor separately,and use the legal policy development of Japan Dispatched Employment Law to discuss the subjects above. In the process of discussing,this thesis separate the legal policy development to three periods, and analyze the legal measures on working stability of the three periods. And this thesis get a conclusion, that the working stability of dispatched employment should be focused on the protection of dispatched employment labor’s working stability,not the typical labors’.
