2009-01-012024-05-17https://scholars.lib.ntu.edu.tw/handle/123456789/695435摘要:十九世紀末,日本首次將西方的國籍觀念及制度施行於台灣。當日治下台灣人跨越國境而前往中國,或住在中國者跨越國境而來日治下台灣過生活時,國籍就有其意義。例如同一家族內居住在台灣者,到先祖居住地的中國時,因國籍不同而適用不同的國家法或司法程序;居住中國之華人,即令與台灣華人講同樣語言,也因為國籍不同,而在台灣得到不同的法律上對待。「國籍」因而是具有實質上的利害關係的概念,究竟國籍之有別,已導致人們在民事及刑事法律生活上,得到什麼樣不同的待遇?這樣的不同,又讓台灣人對國籍有了什麼樣的體會或了解?正是本研究計畫所欲回答的問題。本研究計畫的第一年與第二年,將探討日治時期台灣人進入中國,因擁有日本國籍之故,而於民事及刑事法律生活上,與同種族、甚至同語言的當地中國人有什麼樣不同的境遇或經驗。由於當時台灣人在中國的人口,以華南居多,故第一年集中談華南地區的情形,第二年再談華南以外的地區,特別是在滿州國的情形。第三年則探討當時的中國人進入台灣之後,亦獲致與具有日本國籍的台灣人如何不同的法律上待遇,而台灣當地人又如何看待這群種族文化,甚至語言與其相似的「外國人」。<br> Abstract: In late nineteenth century, the concept and institution of Western nationality were brought to Taiwan for the first time by Japan. When a Taiwanese with Japanese nationality crossed the Taiwan Strait to arrive in China, or a Chinese citizen crossed the Taiwan Strait to arrive in Taiwan governed by Japan, different nationality made a certain sense for their lives relating to civil law and criminal law. In other words, two persons who have the same ancestor would apply to different laws or acquire different legal treatments just because of their nationality. Thus, the concept of nationality had substantial meaning for the general public. This research project wants to explore to what extent did the Taiwanese catch such meaning of nationality during the Japanese period. This is a three-year project. I would like to discuss how the legal treatments of a Taiwanese with Japanese nationality were different from those of a Chinese citizen when this Taiwanese went to China. The attention will be paid to the Taiwanese who went to Southern China in the first year of this project and be paid to the Taiwanese who went to the other areas of China in the second year of this project.
