2006-10-312024-05-17https://scholars.lib.ntu.edu.tw/handle/123456789/684773摘要：動物保護法已經實施將近八年，而其相關法令也日趨完備。不過，本法於立法當初並無法律專業人士的參與，法規中難免有些相互矛盾或甚至窒礙難行之規定。再加上政府行政能量不足、機關合作機制並未建立等因素相擾，整體而言，除少數縣市外，本法的落實程度誠令人質疑。 與上述法律實施狀況相左，近年來受到國際局勢的影響，以及媒體的傳播，部份國人已經有了一定的程度的動物保護概念。只要有虐待動物的事件發生，則指摘法律規定的不足，或批評政府執法不力。這種局勢使得本就是窒礙難行的現行動物保護法規失去了法律的尊嚴，而政府也承受了頗大的壓力。 本研究擬結合法律與動物的專業，重新檢視現行法規。除參照國外最新的發展外，更期待能夠把這套法律修訂得符合本土社會現實，進而確保法的執行力。 本研究計劃進行三個領域的研究，包括動物保護法修正、寵物買賣業與繁殖業的管理，以及寵物買賣定型化契約的擬定。 <br> Abstract: It has been almost 8 years since the execution of Animal Protection Act, and related regulations have been gradually completed. However, due to the lack of legal professions participating in original legislation, it was hard to avoid some contradictions or norms which were difficult to be put into practice. Furthermore, owing to insufficient administration and the lack of cooperation mechanism between government organizations, the level of enforcement of the Act in general was in doubt. In contrast to legal efficacy discussed above, a few people have already built certain concepts of animal protection as a result of the influence of international situation and mass media. Once animal abuse occurs, the insufficiency of the Act and the inefficiency of its enforcement are blamed. This deprives current animal laws of the dignity, and also exerts pressure upon the government. The research is to combine the professions of both law and animal to review current acts and regulations. In addition to referring to the latest development overseas, these laws are expected to be amended to fit in with the social context, in order to ensure the efficacy of enforcement.
