2007-09-152024-05-17https://scholars.lib.ntu.edu.tw/handle/123456789/672167摘要:近年來雖然頻傳虐待動物的事件,但是整體而言我國已經逐漸建立起動物保護的法制,而且寵物也早已超越了「物」的範疇,基於其也是一個生命體,現今已逐漸被視為家族的一份子,甚且欲廢棄「寵」物這個有明顯上下階級意味的字眼,而改稱其為同伴動物。縱或如此,現今的法律僅規範到寵物的繁殖、買賣、寄養、飼養、管理與保護等層面,對於往生後寵物的處理卻沒有任何合理的法律規範,頂多是將其視為廢棄物,而用廢棄物清理法予以處理。事實上官方的處理方式是由環保單位或動物檢疫單位,以寵物屍體的重量為計價標準,並於數天後一次集體焚化,此種處理方式經常令飼主無法忍受。當然對於屍體的處理方面,我國訂有殯葬業管理條例,但是所管理者是處理人的屍體的殯葬業者,並不及於處理動物屍體的業者。就此而言,一方面現今寵物的屍體不宜視為是一般民刑法規定中的所謂的「物」,所以不宜以廢棄「物」待之,但另一方面其又不是「人的屍體」,所以也不宜用殯葬業管理條例來加以規範,據此有論者即提議應該就寵物的屍體處理另立法律或行政命令予以規範。<br> Abstract: Although animal abuses have been frequently reported recently, there has been increasing contribution to animal rights within the field of legal system. Animals are now considered “life” rather than “object” to possess. The word “pet” is also gradually abandoned in legal documents for it implies the dominant relation between humans and animals. However, existing laws regarding animal rights tend to be restricted to the breeding, feeding, management, trade, and protection of animals. There is relatively less regulation in terms of the disposal of dead animals. Within this existing legal framework, bodies of dead animals are often dealt with by local government, including environmental protection authorities and animal quarantine authorities, in a rather inhumane fashion. They are collected and put into a central burn incinerator by the local government who charges pet owners disposal fees estimated by the weight of each pet. These methods of the disposal of dead animals seem to be unacceptable to their owners. Existing regulation regarding the disposal of human corpse - the Mortuary Service Administration Act - is unable to be applied to animals. The Mortuary Service Administration Act focuses on morticians that deal with human corpse rather than those who manage animal bodies. On the one hand, the disposal of dead animals is not regulated by the Mortuary Service Administration Act. On the other hand, bodies of dead animals are not conceptualized as “objects” in civil and criminal law, and, hence, not able to be treated as waste objects in existing legal framework.
