2014-03-192024-05-18https://scholars.lib.ntu.edu.tw/handle/123456789/701481摘要：本計畫旨在透過國際經貿法律制度下之發展趨勢，研析各項衛生福利相關議題並提出相關法律意見。本計畫將處理下列議題： (一) 國際經貿衛生福利相關議題之法律諮詢 經濟全球化及貿易自由化的趨勢，對於世界各國公共衛生、醫療保健服務及公共福利等之專業領域，均產生衝擊與挑戰。我國於2002年元月起成為「世界貿易組織（WTO）」的正式成員後，該組織下的各式協定（例如：SPS、TRIPS、TBT及GATS等），對我國政府之公共醫療衛生事務已具有規範效力。鑑此，本計畫將提供專業之法律意見，俾能有助於相關政策之形成。 (二) 對經貿衛生專業知識之瞭解及增進我國衛生法學之國際交流 本計畫將針對國際發展趨勢、投標單位需求，設計出國際性、專業性之議程，舉辦國際經貿與衛生福利研討會。期望藉由議程的妥善規劃及研討會的落實，提升投標單位同仁對現階段國際重要議題的瞭解與掌握，並增進我國衛生法學之國際交流。 (三) 研析國際關切議題以因應國際發展趨勢 本計畫希望透過蒐集及研析相關國際經貿衛生組織有關公共衛生與經貿之焦點議題，協助招標單位掌握及因應國際發展趨勢，並提供具體可行之建議，供招標單位參酌，以落實於國際衛生事務之運作實務。 <br> Abstract: The purpose of this initiative is to research and analyze the relevant issues of health and welfare, and provide legal opinion thereon, through the observation of the trends toward which the law of international economics and trade develops. This initiative will address the following issues: (1) Legal consultancy on the relevant issues concerning international trade, public health and welfare The growing trend of economic globalization, accompanied by the development of trade liberalization impacted the professional field of public health, the services of medical health care, and the public welfare in countries around the world. Since Taiwan acceded into the World Trade Organization (hereinafter “WTO”) in January 2002, the WTO covered agreements, which includes but not limited to SPS, TRIPS, TBT and GATS, are legally binding upon Taiwan government, and the regulation of which may affect the domestic governance in the area of public health, health services, and the public welfare. Based on these reasons, this initiative will provide professional legal opinions so as to help the development of relevant policies. (2) The understanding on the professional knowledge regarding the international trade, public health and welfare, and the improvement on the international development of health law Based on the trends in international development, and the needs of the entrusting authority, this initiative will design the international and professional agenda for the up-coming “2014 Conference on Public Health and International Trade”, hoping that the tailor made agenda and the realization of these conferences may help enhance the entrusting authority and the colleagues therein the ability of understanding the relevant up-to-date international issues, and improve the development of international health law. (3) Research and analyze the relevant issues that have been concerned by other countries, so as to respond to and keep step with the international development trend By collecting, researching and analyzing the top issues of public health and international trade in the relevant international organizations, and providing the relevant practical advices thereon, this initiative hopes to assist the entrusting authority in the understanding of the trends in international development, and making responses toward which, so that the entrusting authority may take account of them in the realization of practices of international health affairs.國際經貿公共衛生公共福利International economic and tradePublic healthPublic welfare
