2016-08-012024-05-17https://scholars.lib.ntu.edu.tw/handle/123456789/683224摘要:東亞國家的政治與經濟能力逐漸增加,其與國際各種資訊和資源交流日益頻繁更使其越來越受到重視。同時東亞國家法院在面對經濟和政治變遷與全球化衝擊中,也展開了一連串的法律和司法的重塑,使法院除了傳統的紛爭處理者外,也扮演了促進對話和穩定社會的重要角色。而法院本身的組織與運作除了來自於法律繼受外,也往往與各地區的背景與發展息息相關。因此掌握東亞國家法院的形貌與功能,更具有實務與學術上的高度重要性。因此本計畫選擇透過觀察法院的形貌與功能,來歸納和呈現背景與發展多元東亞國家特有法治文化。本計畫深入分析與比較東亞法院的制度與案例後,提出型塑東亞法院的三條軸線。此三條軸線分別為「傳統與繼受」、「轉型與建制」與「全球關聯與對話」,表現東亞法院在各發展脈絡下的三種重要推力。   本研究並進一步以三條軸線作為出發點,深入分析亞洲多國法院制度與判決,觀察法院在不同的背景脈絡下的策略和功能發展,進而發掘了不同國家法院與政治社會的互動模式。另外本計畫並從憲政主義的角度思考,觀察法院如何透過運作來實踐西方的人權價值與法制文化並將其在地化而融入社會,進一步反思東西社會間是否有所謂普世價值存在,抑或是東方特殊主義的主張也化約了東亞國家的多元性。 <br> Abstract: As the uprising of the East Asian countries’ economic and political strength, and with the trading of information and resources between East Asia and the international society grown stronger, the development of East Asia has gradually been noticed by the world. At the same time, in response to the profound economic and political transition and the conflicts brought by globalization, a series of legal and judicial reforms were also undertaken by East Asian courts. Under these reforms, the courts in East Asia not only become the traditional adjudicator of legal disputes, they also play an important role of promoting dialogue between different departments and enhancing social stability. Although the institution of courts was usually built from Western legal transplantation, it was also influenced by the local, traditional, cultural, and social transitions. In light of this phenomena, this project tried to look into the institution and the function of courts in constitutional, administrative, civil, commercial and criminal matters to identify a constitutional theory of “East Asia.” The most significant achievement of this project has been the establishment of the research method and legal theory for East Asian courts, which has placed more importance on court research in the field of legal studies. Without a theoretical structure for analysis, systematic studies on Asian courts will be impossible due to the political, economic, societal and cultural diversity among Asian states. This project has proposed three dimensions – “tradition and transplantation,” “transition and construction,” and “globalization and competition” – in which Asian courts can be analyzed. This project use these three dimensions as tools to analysis the behaviors and judgments of Asian courts in different countries. This project observes courts’ strategies and function under different social background and context, and discovered the different interaction models between courts and civil societies. Furthermore, this project involves the perspective of the constitutionalism to figure out how East Asian courts function to become the guardian of human rights and integrate with traditional cultural of East Asian countries.
