2007-09-012024-05-18https://scholars.lib.ntu.edu.tw/handle/123456789/706815摘要:本計畫將延續與擴充上一年度「臺灣法實證研究資料庫建置計畫」之成果,並規劃出一套有效率觀測臺灣法與社會之動態與靜態關連性的法實證模式,以累積足夠的法實證資料供產官學界共同使用。有感於諸法實證資料的多樣性以及特殊性,不論是在基礎理論思維、蒐集方式、資料屬性、呈現方式、實際蒐集的技術操作等各有其特色與難度,例如法律文件蒐集之意義在於,透過文字與格式能記錄下當時法規範的實際運作狀況。因而跨時代的法律文件收集,是歷史法實證研究者所迫切需要的,但往往礙於法令限制、人力調度、儲存空間等因素而難以廣泛進行。又或者我們可以藉由現代社會學主流最擅運用的研究調查方式,進行大規模、有效率且嚴謹的法律與社會變遷問卷調查研究,探知臺灣民眾對於法律的態度、法律如何影響人們的行為,若能長時間以定期問卷調查模式累積足夠的資料量,便能逐步勾勒出臺灣法律與社會變遷的圖像。因此,如何累積足夠的數量、規劃出有系統的呈現方式,以利使用者搜尋、瀏覽和建立功能完善的資料庫,這都是本計畫試圖解決的課題,也勢必仰賴各專業領域之胼手合作,藉由實際操作以共謀達成法實證資料庫建置之目的。<br> Abstract: Empirical research is one of the most neglected research methods in Taiwan’s legal academy. In light of the significance of sophisticated empirical methodology in legal studies, the National Science Council has initiated the idea of establishing a database to promote empirical legal studies (ELS), and has founded a one-year project to fulfill this goal in 2006. The purpose of this project is to update and continue the establishment of the Taiwan Database of Empirical legal studies (TaDels), in hope of promoting the application of empirical research in law. This project will maintain and update the TaDels website, which serve as the platform of the TaDels project with the purpose of enhancing communication between the project team and general users, and will establish two sub-databases: survey database and legal documents database. First, survey research method/sampling research is a research method commonly used in social science research. It is, however, rarely used in legal studies. The purpose of this project is to design and complete a nation-wide « law and social change » survey, which will be conducted through rigorous sampling designs and carefully designed questionaire interviews, and will provide national representative survey data on the relationship of law and society in Taiwan. This is a pioneer project, as there has never been a survey of this kind in Taiwan. In the first year, we will organize a team composed of legal scholars and survey research experts to design questionaires that covers various topics on the impacts of law on society and of society on law. A formal survey on the adult population will be conducted in the second year. We will adopt an open data release policy, so that scholars and students will be able to employ the data for their research. All survey data will be archieved in our database, and will be available for free to the general public in the third year. Through the team work of the main project and the three sub-projects, we aim to make the TaDels one of the leading database resources for empirical studies of law, so as to promote ELS and serve the broader academic community. Second, legal documents are important empirical materials. They define and enforce legal relationships in our daily lives, provide legal information, and serve as basic research materials for scholars of empirical legal studies. We aim to gather legal documents and establish an research-oriented database, which contains documents concerning the following four topics: (1) personal safety; (2) personhood and personal identities; (3)standard/adhesion transaction contracts; and (4) dispute resolution. This is a three-year project, and we have planned two topics for each year.
