2006-11-012024-05-17https://scholars.lib.ntu.edu.tw/handle/123456789/670223摘要：我國現行主要的全國性體育運動團體計有中華奧林匹克委員會；中華民國體育運動總會；其他與中華民國體育運動總會類似等級之體育運動總會（尤其中華民國殘障運動總會）；各級地方體育會；各單項運動協會；職業運動之營利組織（包括聯盟性質者與球團性質者）。現行法制係《人民團體法》作為體育團體之登記規定，以及《國民體育法》（以下簡稱本法）第8條之授權而於91年10月11日以體委綜字第0910017993號令所訂定之《全國性體育團體輔導及考核辦法》。 本研究的重點，為我國中華奧會；中華民國體育總會；各種單項運動協會的建制與相互關係，以及藥檢規定。實際內容上必須以國際奧會的憲章以及國際運動競賽藥檢（指運動員有沒有濫用禁藥之檢查與裁決或甚至申訴等）當作標準。第二個工作重點，為各主要國家的體育團體與藥檢等制度。第三個工作重點，為我國三大類組織應有的制度設計。第四個工作重點，則是於期中報告之後，或甚至更晚，依據體委會所決定的政策，著手研擬國民體育法相關條文的修改。 詳言之，依據體委會的要求，本計畫將研究如下子題： 一；關於中華奧林匹克委員會（以下簡稱中華奧會）相關法制 （一）；中華奧會之相關法制，必須合乎《<br> Abstract: This research aims to analyze the legal framework and practical difficulties of the different levels and kinds of sport organizations in Taiwan, with a view to following up the worldwide trend. Dominant in this policy field is the Olympic regime, characterizes with the Olymic Charter；the International Olympic Committee (IOC),the International Federations (IFs),World Anti-Doping Code etc. Taiwan has built up the same system, with Chinese Taipei Olympic Committee,Republic of China Sports Federation and various kinds of specific sport organizations on different of levels of governments. Throughout the times in the authorian regime (1949-1986) and post-authorian regime (1987-1995), and with the beginning of the democratic consolidating period (1996-),the social forces- of which sports organization are just one kind- are entangled in a powerless situation due to the different kinds of restraints. The time for an institutional reorganization and reengineering of them has come. This is the purpose and task of this research.
