2010-05-012024-05-18https://scholars.lib.ntu.edu.tw/handle/123456789/705110摘要:關於基因生醫科技研發與應用創新與其他科技產業最大不同處在於生醫科技研究之研發時程超長、同時該領域亦有大量資金投入之必要等。對此二關鍵之處,可以說前者係為避免風險集中於少數公司而特別重視上游與下游之研發分工體系;後者則係因應生醫科技長期研發之成本需求。簡言之,生醫科技研發與應用相當重視研發成果的法律權利保障及成果利益分配。 本計畫研究目標係為「著重於研發成果專利保護問題,並從訴訟面深入探討專利權人主張權利之可能性問題」,其係以智慧財產權與基因生醫科技研發活動之關連性為中心,而著重於現行法制與司法判決實務下,專利權的實踐對於基因生醫科技研發與應用的影響。 而本年度之研究目標為「國際專利訴訟最新發展趨勢對基因生醫科技研發之影響」,從訴訟面深入探討專利權人主張權利之可能性問題。以智慧財產權與生醫科技研發活動之關連性為中心,本研究著重於司法判決實務下,專利權的實踐對於基因生醫科技研發與應用的影響,期待藉由借鏡專利法先進國家於相關議題的經驗,釐清我國現有法制與司法實務對於基因生醫科技研發與運用的缺失,檢討相關可行之方法。綜言之,藉由整理分析近年來國外專利訴訟之發展,提供我國智慧財產法院在專利判決時之參考,以利生醫科技研究環境健全化。 <br> Abstract: Genetic biological and medical technology fields, in contrast to other technology fields, require extremely long R&D periods as well as considerable amounts of money. The long R&D periods are due to risk management by spreading the R&D tasks to several sub-contractors. Increasing R&D periods then further increase the costs. As a result, there are great needs for legal rights protection and sharing of benefits of the R&D results. Currently, the research goal of this program is about “patent protection of the developed results, and discussing the possibilities of patent owner to claim their patent rights from the litigation perspective”. It emphasizes intellectual property rights and genetic biological and medical technology, as well as how the practice of patent right influences genetic biological and medical technology under the current legal system and judicial practice. The annual research goal is the “Study upon the influence of the latest development of international patent litigation upon innovation of genetic biological and medical technologies “, aiming at deep discussions to the possibilities for patentees to claim their rights, from the viewpoint of litigation. From the core concept of the relations between the activities of genetic biological and medical technologies and the intellectual property rights, this research will focus on patent litigations and their impacts upon the researches of genetic biological and medical technologies. Hopefully from the experiences of countries with advanced patent systems, we will clearly notice the defects in Taiwan’s law system and litigation practices of the researches and usage of genetic biological and medical technologies, and try to find possible ways to solve them.
