2008-01-012024-05-17https://scholars.lib.ntu.edu.tw/handle/123456789/680775摘要：1.計畫名稱：「公共治理的規範變遷：台灣經驗與比較視野」 (The paradigm shift of public governance and its legal consequences:Taiwan in global comparison ) 計畫主持人：葉俊榮 共同主持人：王文宇、林仁光、簡資修、汪信君、張文貞 2. 計畫背景 新公共治理的典範在全球各先進國家方興未艾，在傳統公權力之管制外，結合市場體系、經濟誘因、風險分擔、或透過企業及其他自主性組織設計等方式，以提高市場競爭力並提升公共福祉。與此同時，作為新公共治理之規範基礎的實證法體系以及其背後之規範理論與政策，也面臨重大轉型。傳統以公法（尤其是行政法）/私法（尤其是公司、證券市場、保險、甚至民法體系上的侵權行為等）為界分的法律體系及理論，更是首當其衝。 此一趨勢，不僅已經反映在許多國家的管制實踐上，在法學研究上也已清晰可見。尤其在近年英語世界的法學期刊上，不管是一般性或具體領域的管制規範評析或檢討，絕大多數被接受發表的論文都是打破傳統法際界限，整合行政管制、公司治理、風險分擔，才能真正對相關之規範議題作妥適、甚或前瞻之分析。其實，台灣在實際的行政治理上，早就已經面臨前述趨勢所帶來的諸多衝擊，引發社會關心之議題如ETC招標、金管會或通傳會之權限等等，莫不與此一打破傳統法際界限之新興趨勢相關。 3. 計畫目的 在前述研究背景之下，本計畫預計以公共治理及管制革新所帶來之法際整合衝擊為研究主軸，希望整合院內熟悉此一研究主軸並能跨越傳統公/私法界分之研究團隊，有效提升研究團隊成員之研究量能，以個別或集體合作之方式進行國際期刊之論文發表，並邀請此一領域重要之英美學者來台與團隊成員共同開課或舉行密集之研究工作坊(research workshops)，以真正刺激並提升本院在此一重要新興領域議題的國際學術表現。 4. 計畫內容： （1）「公共治理規範之典範變遷」寫作工作坊（Writing Workshops on Paradigm Shift of Public Governance and the Law） 為有效提升本研究團隊之國際期刊發表，預計於計畫執行期間內每月定期舉行寫作工作坊，以促成研究團隊成員在本研究主軸下，以台灣經驗為主，個別或集體的英文寫作合作。 此一寫作工作坊，並擬邀請國內學者（以經濟或管理學院有相當卓越之國際發表成果之學者為主）及英美學者（以能整合行政法與私法或管制理論研究之重量級學者為主，如Martin Shapiro, Jerry Mashaw, Cass Sunstein, Ian Ayres）等，針對研究團隊成員之論文及研究成果，給予評論並協助指導。英美學者之邀請並將結合後述(3)之學術研討會，以最有效方式來整合相關資源，提升本院教師之論文發表量能。 本項目屬於本院補助標準「（三）補助本院教師發表專書、SSCI論文」及「（五）其他可提升本院研究能量之重要具體方案」。 （2）「公共治理與法律變遷：台灣經驗的國際比較」學術研討會 本計畫預計以公共治理及管制革新所帶來之法際整合衝擊，尤其是透過台灣與各新興市場國家之規範變遷上的比較，來參與目前英語世界之學術期刊對此一重大趨勢的探討，同時也將台灣過去發展上的重要經驗予以理論化及、學術化，提升其國際能見度，舉辦國際學術研討會，有其必要性。 不過，本計畫將要求團隊成員，透過先前一系列寫作工作坊之舉辦，在舉行學術研討會之前，就已經可以提出具有投稿國際期刊水準之論文，學術研討會的舉辦是在收成先前寫作工作坊之成果，透過研討會之舉辦進一步提升論文各方面之水準，在研討會舉辦之後即有相當數量之論文可以發表於重要之期刊，以真正能有效提升本院的國際學術表現。 本項目屬於本院補助標準「（四）補助本院教師舉辦大規模、國際性之研討會」及「（五）其他可提升本院研究能量之重要具體方案」。 5. 執行時程：2008.03.01-2008.12.31 <br> Abstract: 1.Backgrounds: The paradigm of new public governance prevails in the western world. Beyond the traditional command-control, it includes the market system, economic incentives, risk sharing, the design of self-regulation organization, and the function of corporation to enhance the market competence and the public welfare. Simultaneously, the normative perspective of new public governance face an dramatically shift in its substantial and theoretical foundation. It primarily impacts the traditional system and theory, which divides the law system to public(especially the administrative law)/private(especially the corporation law, financial market law, insurance law, even the torts in civil law system)sphere. This tendency not only reflects on the regulatory practice, but apparently emerges on the research area. The judicial reviews in English world recently accept the essay, which cross the territory already build. In fact, the administrative practices in Taiwan have faced the impact, which the above tendency brought. The social concerned issues, such like the biddings of ETC system, and the competence of FSC and NCC, are relevant with this prevailing tendency. 2.Goal & Plan： Under the backgrounds mentioned above, this project focus to research about the impacts, which were accompanied with the regulatory reforms, to the traditional division in public/private way. This group tries to summon the experts, who are familiar with this focus and have the capacity to cross the division. This group expects to present the articles in the international academic law review individually or together. Furthermore, inviting the important western scholars to join the school program or the highly concentrated research workshops this group holds. In the prospect of the promotion of the performance of NTU law college in this important and prevailing area. 3.
