國立臺灣大學政治學系Department of Political Science, National Taiwan University蔡達棠Tsai, T.T.T.T.Tsai2017-09-082018-06-282017-09-082018-06-281994-04http://ntur.lib.ntu.edu.tw//handle/246246/281749臨時提案泛濫，是近幾近來立法院出現的新問題。 按理而言，臨時提案應提為解決緊急突發事件而設，但目前六一法院的臨時提案卻變成了立委們表現的舞臺，主席既無力阻絕以臨時提案為由的議事杯葛，也無法禁止立委不依議載規則提出臨時提案；處理臨時提案變成了立法院的例行工作。當今的狀況，顯然與臨時提案的本質大相逕庭。 本文即試由法源、種類、執行與其流弊等方面分析臨時提案，並對當今臨時提案濫的情形提出因應之道。The overuse of the incidental proposition has become a recent problem in the Legislative Yuan. An incidental proposition is originally created to handle emergent issues. However, the Legislators have used it as a convenient means to boost their performance in the Legislative Yuan. The Speaker cannot blockade a boycott in the form of an incidental proposition by violating the rules of legislation. Consequently, it has become the case that incidental propositions are made almost dialy during the session. Such a result has obviously contradicted with the original function of incidental propositions. This essay will try to analyze incidental propositions with respect to their legal bases, categories, practices and defects. A solution for the problem of overusing incidental propositions will also be suggested.journal article
