2018-04-012024-05-17https://scholars.lib.ntu.edu.tw/handle/123456789/685536摘要：本研究從法律觀點及行政程序、爭訟實務切入，協助科技部生科司處理近來頻發的研究誠信違反行為，除減輕生科司有關於此之行政負擔外，並期望於前階段違反行為處理過程中，即納入未來行政爭訟可能產生之法律爭議，盡量以前階段的完整處理程序，減少未來訴諸行政爭訟的必要性及法院對於前階段處理程序適法性及程序爭議保障可能發生之質疑。同時生科司違反研究誠信行為之特性，從預防觀點思考未來解決之道。具體的研究內容包括： 1.從法律觀點協助科技部生科司處理違反學術倫理之具體個案處理作業機制之建立 2.隨時就所涉及法律議題與科技部生科司共同檢討因應方式 3.檢討如何建立科技部生科司就學術倫理案件處理作業程序之SOP 4.檢討如何建立論文發表時之「共同作者」之列明標準並提示之 5.檢討實際案例中「共同作者」之案件是否應啟動學術倫理調查程序 6.依據先前之資料針對是否「致有嚴重影響本部審查判斷與資源分配公正之虞」之要件予以明確化之界定 7.根據過去案例研擬科技部生科司應如何處理違反學術倫理之處罰標準 8.檢討科技部以外單位對於違反學術倫理案件之處理模式，以做為科技部生科司處理之參考 9.從過去的案例中分析「研究過程」及「論文發表」二面向之違反學術倫理之行為類型 10.基於整體研究計畫之所得檢討科技部生科司未來改善研究發表倫理之具體方式及作法確保「研究過程」及「論文發表」符合學術倫理之要求 11.將具體案例之發生以及處置以專刊或專書呈現分析結果，提供學界參考<br> Abstract: The main purpose of this research is to assist Department of Life Science of Ministry of Technology in processing cases regarding misconducts of research integrity from the legal points of view. By taking into considerations of human resources burdens and legal burdens that will be borne in the following administrative suits, it is necessary to establish a complete due process and standard operation process in the early stage of case-handling. At the same time, this research will try to explore the features of misconducts of research in life science field and accordingly figure out fair and reseanable preventive measures which can decrease the frequencies of misconduct of research in life science field. The items that should be done during this research are listed as follows: 1.Assisting Department of Life Science of Ministry of Technology in processing cases regarding misconducts of research integrity from the legal points of view. 2.Cooperating with Department of Life Science to solve legal issues arising from its cases regarding misconducts of research integrity. 3.Establishing a standard operation process of how to handle cases regardingm misconducts of research integrity. 4.Clarifying the standards for judging "authorships." 5.Clarifying the standards for initiating investigative process regarding authorships. 6.Defining the requirement "resulting in material influences on fair peer review and allocation of research resources. 7.Drafting the standards of sentencing regarding misconducts of research integrity 8.Investigaing standard operation process of other organizations regarding case management of misconducts of research integrity 9.Classifying misconducts of research integrity from the views of "research process" and "publication" 10.Figuring out appropriate approaches that can assure researcher in compliance with research integrity when conducing researches and expriments 11.Publishing the results of the reseach to provide references for researchers of life science field.負責任的研究行為不當研究行為抄襲研究治理研究誠信造假著作掛名學術倫理變造academic ethicsauthorshipsfabricationfalsificationmisconducts of researchplagiarismresponsible conduct of researchresearch governanceresearch integrity
