2009-08-012024-05-17https://scholars.lib.ntu.edu.tw/handle/123456789/695077摘要：法學是一門應用性很強的學科，法學教育的重要目標之一，是培養學生運用法學知識解釋法律現象、解決法律問題的能力。因此，在法學教育中，理論和實踐相結合的教學方法具有特別重要的意義。實踐證明，案例教學既是法學教育的重要內容，也是法學教育的重要方法。英美法跟大陸法學習方式最為不同的一點在於：大陸法是以法條為中心，學習重點在於理解法條，案例僅為補充，而英美法則以案例法為學習重心，從案例理歸納出原則，法院判例具有立法性質，也是重要的法學知識。在我國，近年來案例研究逐漸受到重視，為加強國內法學教育、強化案例教學，發展法律系所學生適用之法律課程，且教材內容應強 調實際案例之運用，實在刻不容緩。本專書寫作計畫的基本目標在於，透過案例評析豐富和活化國際法課程，激發同學對於國際法議題的興趣和解決國際法問題的能力。 本《國際法：案例及資料》專書寫作計畫的主要目的在於：經由本書所擷取的案例系統性反映國際法之主要制度，本計畫編纂之課程教材亦可作為大專院校法律系學生修習國際法之基本教材。為使學生能在較短的時間內獲得國際法最為基礎之知識，編纂者將在每一章節的開頭部分對該章節所涉及的法律原理作簡要論述；此外，本書各章設有特定國際法經典案例研究，以鞏固學生的國際法理論和知識，並在該等國際法案例之後附上思考題，使讀者可以藉閱讀案例得到答案，並加深其對案例中闡明的法律原理之理解。筆者希望，讀者能夠在閱讀這些案例的過程中，不僅清楚明白每一個案例之事實、判決結果和法官的推理過程，且能透過這些案例瞭解國際法之法律制度，以及其所體現之價值觀念。本書將適合於國內大學法律教育在國際法教學與國際法案例教學中作為教材使用，也適合其他系所而對國際法具有興趣的學生或其他領域的讀者，作為加強國際法專業知識之用。 <br> Abstract: In legal science education, there is significant to combine theory and practice in study of law. The differences between ‘Common Law system’and ‘Civil Law system’are the civil law system lays emphasis on interpreting the provision of law, on the contrary, the common law system pays attention to cases law and generalizes principals from them. The main purpose of this project is to enrich the international law curriculum and catch students’eyes on the theme of international law. Moreover, the cases selected in this book systematically reveal international law main system and theorem. This achievement of this project also can be the basic learning material of international law area for law school students. In order to make readers understanding the basic knowledge of international law as soon as possible, there has summary of legal principals in the beginning of every chapter and section in this book. In addition, there are several questions following the cases, and this way can make readers realizing more about the international law and achieve mastery through a comprehensive study of this project. In conclusion, the purpose of the “international law: cases and materials”writing project is to initiate a new method of teaching and studying international law in Taiwan, and this book of “international law: cases and materials”can be the basic textbook of international law for students who are interesting in this subject.國際法法學教育案例教學international lawlegal science educationcase law study
