2006-09-012024-05-14https://scholars.lib.ntu.edu.tw/handle/123456789/658438摘要：法實證研究，是為了對法現象進行社會科學說明所進行的經驗研究，也就是以實證研究的方法，將抽象的法律置於具體的社會中來理解。這樣的研究取徑不論對於學術研究、立法政策或司法實務而言，均具有相當之重要性，但卻未受到台灣法學界的重視。長期以來，台灣的法學研究以法釋義學為主流，規範與實務運作之間缺乏相互對照、反省。因此，在現階段實有積極提倡法實證研究之必要。但在台灣不僅不受到重視、甚且十分受到輕忽，實有予以提倡發展之必要。在本計畫中，我們扼要地說明了法實證研究的理論思考與方法面向，闡述了法實證資料的種類，論證建置法實證研究資料庫的必要，並具體提出法實證研究資料庫、實證調查其他研究資源之規劃設計，期能透過法實證研究資源之建立，促進法實證研究的發展。<br> Abstract: Empirical legal studies provide knowledge about a host of legal phenomena on the basis of empirical evidence, which shall inform legal policy and enrich legal theory. Such scholarship enables us to gauge the effect and efficiency of particular legal mechanisms as they operate in a particular society. In the global legal academy, empirical legal scholarship has joined the ranks of mainstream. It is yet one of the most neglected fields in Taiwan. This projects aims to establish the Taiwan Database for Empirical Legal Studies (TaDELS) and other relating research resources for the purpose of promoting empirical legal studies.
