2007-01-012024-05-18https://scholars.lib.ntu.edu.tw/handle/123456789/698959摘要：在邁向現代化與國際化的今日社會中，工程法律之研究，無疑是目前法學領域中極其重要的一環。因為這一門學科所強調的，不僅是法學理論如何配合現代工程實務之真正需要的問題，而在理論的層面中，各公、私及內、外國法律等又將如何相互整合，以建構出完整的工程法律體系，更是這一門學科所必須追求的目標。是以，本研究計畫，即在此一研究背景的要求下，將透過加強國際學術交流與跨科際研究（如結合工程界與法律界）等方法，針對「工程契約」、「工程爭議解決機制」、「政府採購法」及其他營建、環保、勞工、保險等相關法制的議題，進行全面性的探討；至於最終的目的，則在於提昇我國工程法律之研究水準，並就如何健全我國工程相關法制，提出具體可行的建議，以供土木工程界及政府或其他公共部門參考。本研究計畫參與之人員，預計將以單獨或共同的方式，發表研究成果，並在施以嚴謹的執行與考核方案下，鼓勵參與人員追求卓越。整體而言，本研究計畫希望能在實施四年後，至少促使我國工程相關法制進行全盤檢討，而工程契約之研究，也能與國際工程契約實務相結合，以達到全面現代化及國際化的目標。<br> Abstract: Construction law undoubtedly plays a vital role in the field of law as our society becomes more modernized and globalized. It stresses not only the integration between theory and the practical needs of modern constructions but also emphasizes the importance of integrating private and public, local and foreign laws to build a comprehensive body of construction law. With these emphases in mind, the present thesis discusses the issues of construction contract, construction dispute resolving mechanisms, government procurement law and other related issues such as construction, the environment, labor, and insurance, among others. Discussions will be achieved through enhancing international scholarly exchanges and interdisciplinary studies, such as integrating engineering and law. The ultimate goal is to raise the standard of our nation’s construction law, and propose suggestions for more comprehensive legislations for the reference of the civil engineering field and various government and public institutions. The results of this research project will be published singularly or jointly. Under discrete execution and assessment, project members are encouraged to pursue excellence. Overall, it is hoped that in four years this project will stimulate a comprehensive discussion of local construction laws.
