2008-01-012024-05-13https://scholars.lib.ntu.edu.tw/handle/123456789/655016摘要：工程相關法制之研究，向來被認為極其專業。縱使受過專業法學教育者，亦未必能正確瞭解工程爭議之所在，公平解決其爭議，相反地，工程界雖較能掌握工程法律之規範內容，卻因未受過法律專業訓練，對工程爭議之紛爭解決程序與工程契約法律之法律適用，無法正確掌握，職是，工程與法律之整合研究對當今工程法律學水準之全面提升不可或缺。 在全球化之世界下，法學之發展已非一國之政策而已，法學之整合實屬必要，從歐洲契約法之統合即可窺之。尤其在工程法律方面，我國尚未成為FIDIC（國際工程顧問聯盟）之會員，很多之招標程序及工程契約條款皆已與國際脫軌，如何將我國之工程法學提升至世界標準，實屬必要。而且我國之廠商至外國投標或外國之廠商至我國投標已屬常態，如何調和各國之工程法律規定，實為各國重要之課題。有鑑於此，為使工程法學之研究與國際接軌，臺灣大學在邁向世界一流頂尖大學之際，在這股全球法學整併之風潮中，實不能缺席，故舉辦本次國際學術研討會，除了能提高臺灣大學的國際知名度外，對於台灣的工程法律發展，亦會有相當大的貢獻。 <br> Abstract: The Construction Law is usually considered a very professional field. Even the people who have had legal education could not clearly understand the controversial issues, on the other hand, engineers, who have not had legal education, could not exactly conduct the dispute settlement procedures and application of law in construction contracts, though they may more apprehend the formal contents of the construction law than legal experts. Consequently, the integration research of law and engineering is essential to contribute to promote the level of the construction law. Nowadays, because of globalization, the development of law is not merely a country policy. The combination of law and other disciplines is a necessarity, which can be seen in the combination of Principle of European Contract Law. In the Construction Law, Taiwan hasn’t been a member of FIDIC, and that cause the procedures of invitation for bid and norms of construction contracts fall behind other countries. Therefore, it is very essential to upgrade the standard of Taiwan’s Construction Law. Furthermore, how to accommodate different legal systems is an important issue as the international public biddings are more and more normal. Thus, in order to bring Taiwan Construction Law research into line with international practice, National Taiwan University, one of the best world universities, should not absent from the trend.
