2006-08-012024-05-17https://scholars.lib.ntu.edu.tw/handle/123456789/687013摘要：本研究計畫旨在建立女性主義法律史的理論、方法與議題。晚近台灣的女性主義法學研究在實證法的領域已有蓬勃的發展，但在基礎法學的領域則仍顯薄弱，特別是在法律史的研究成果上，主要為個別議題的探討、而少有一般性的理論與方法探究。因此，本計畫將探討：女性主義的法律史研究可以根據的理論與研究方法為何？有哪些已被開發、及有待開展的議題？也就是從理論、方法與議題三方面著手，為女性主義的法律史研究建立一般性的基礎，並且提出可能的發展方向與議題。在理論方面，將由女性主義法學理論與歷史/法律史理論著手，探討女性主義的法律史研究，可以奠基在何種對於「歷史」、「女性」、「性別」、「權力」、「宰制」等概念的理解之上展開，類型化既有研究成果的理論立場，並分析女性主義的法律史理論如何可能有助於女性主義的法律改革。在研究方法的探討上，則特別著重於弱勢群體史的研究方法：檔案研究與口述歷史。在議題的探究上，則將回顧相關女性主義的法律史研究，將曾被研究過的議題予以歸納、類型化，並且在此基礎之上進一步展望新議題的可能性與必要性。<br> Abstract: This project is designed to establish theories and methods, as well as to lay out topics for the study of legal history from feminist perspective. In Taiwan, feminist jurisprudence has developed theories and pursued reforms in various fields of law – constitutional law, labor law, family law, criminal law, to name but a few --, but it has only little impact on legal history. To promote feminist legal history scholarship, this project will first investigate theories of feminism, history and law that would be useful for the establishment of theory for feminist legal history. Issues to be explored include, but are not limited to the following: What is “legal history from feminist perspective”? Should it be named and defined as “women’s legal history” or “feminist legal history”? Why is feminist legal history the preferred one? What are the key concepts for feminist legal history? How can feminist legal history contribute to current feminist legal reform? As for developing methods for feminist legal history, this project will focus on two research methods that are among the most useful methods for writing minority groups’ histories: archive research and oral history. In exploring the method of archive research, I will discuss the politics of “archiving” and how archives can be seen as a field of knowledge production, or as sources of historical material. The method of oral history will also be explored to see how it can contribute to writing “the unheard of” and to make women the subject of legal history.
