日本岡山大學法學部;國立臺灣大學政治學系Department of Political Science, National Taiwan University李明峻許介鱗Li, M.J.M.J.LiHsu, C.L.C.L.Hsu2017-09-082018-06-282017-09-082018-06-282000-06http://ntur.lib.ntu.edu.tw//handle/246246/281691本文從國際組織對原住民族的特別考慮,以及原住民族權利的內容兩方面加以介紹。首先,在國際組織方面,聯合國人權委員會「少數民族小組委員會」於一九八二年設置原住民工作小組以推動原住民族權利的國際立法,並於一九九三年向經濟社會理事會提出「原住民族權利宣言草案」。國際勞工組織更通過一 ○七號(修改後為一六九號)條約,明確保障原住民族的權利。此外,世界衛生組織、世界銀行、OECD等亦在保障原住民族的健康、環境等方面進行多項努力。在原住民族權利的內容方面,本文除一般討論較多的自決權、先住(土地)權之外,更觸及文化權、環境權、教育權、發展權等其他權利的介紹。最後,本文特別指出目前國際社會對原住民族權利問題的新認知,以及NGO在其中扮演的角色,希望藉此找出可行的原住民復權之路。This article introduces international protection for indigenous peoplefrom two aspects: special considerations for indigenous people ininternational organizations, and content of indigenous rigerts. First of all,"working group on Indigenous sopulations" of UN's Commission on HumanRights was set up in 1982 to devocate international law-making forindigenons peoples. In 1993, the Draft Declaration on the Rights ofIndigenous people was submistted the fue Economic and social council.Moreover, International Labor Organization passed No. 107 (modified asNo. 169) Convention to recognize indigenous rigats. In addition, WorldHealth Organization, World Bank and OECD have made efforts to promoteprotection for indigecous peopee's health and environment. Secondly,other than traditionally touched upon issues, such as right to self-determination, right of primary occupancy, this article emphasizes emergingrights of indigenous peopee, in euding cultural, environmental, educationaland developmental rights.
