2011-08-012024-05-17https://scholars.lib.ntu.edu.tw/handle/123456789/678348摘要:在傳統的法學典範中,法院的典型功能在於解決紛爭。法院的論述多以個人權利為基礎,最終的目的是為了防止政府濫權、避免人民的權利受侵害。然而,近年來法院面對全球化以及社會的多元發展,已經發展出不同的特質以及功能期待,法院也被認為是社會對話中的重要環節。法院透過審查程序、裁判與裁判中的論述,不斷地在與其他政治部門與社會產生互動。 憲法法院更因為其所處理的憲法案件常涉及社會的重大議題,而承擔更為重要的角色。本研究將從社會對話的視角,從東亞國家的發展脈絡觀察東亞憲法法院的演變,並進一步對其進行評價。東亞憲政主義概念的提出,指出東亞國家在憲政發展上有別於傳統西方憲政主義的脈絡與發展。憲法法院是落實憲法規範的重要機制,東亞憲法法院的制度設計、功能定位與角色變遷也反應了憲政主義的內涵與特色。本研究亦將延伸東亞憲政主義的討論,探討憲法法院所反映的歷史及社會脈絡,包括過去歷史遺留、社會現實以及社會需求等。 本研究將包括四個面向。第一個面向是分析憲法法院的制度設計,並探討其歷史與制度成因。第二個面向是從內部與外部的觀點,探討東亞憲法法院在不同議題上的變遷與功能,包括民主轉型與鞏固、經濟發展、社會整合與人權保障等四個主軸。第三個面向是探討東亞憲法法院的國際化程度與東亞司法網絡的形成。第四個面向則是從各國不同的社會需求分析並評價東亞國家的憲法法院。 <br> Abstract: In the traditional legal paradigm, the prototype function of courts is dispute resolution. In an era of globalization and diverse social developments, functions of courts have changed. Very often, the courts, through decisions and reasoning, play a role in advancing policy formation and social dialogue in an ever increasing complex social nexus. Courts interact with other political institutions and social sectors by reviewing and reasoning targeted processes and policies even under cases and controversies constraints. Among the various types of courts, constitutional courts engage more comprehensively and deeply in social dialogue. This project will analyze the changing roles of constitutional courts in East Asia with the context of social dialogue and East Asia and further evaluate the function of East Asian constitutional courts. The emergence of East Asian Constitutionalism proposes that the constitutional developments in East Asia are distinctive from that discussed in traditional Western constitutionalism. The institutional design, function and roles of constitutional courts are the core element of constitutionalism. Therefore, this project will explore East Asian constitutional courts based on the model of East Asian Constitutionalism, by focusing on historical backgrounds, social reality and global congruence. This project includes four dimensions. It first analyzes the institutional design of East Asian constitutional courts and further enquires into the relevant historical and institutional context. Secondly, from both internal and external perspective, it analyzes the changing function and response of East Asian constitutional courts to issues of common significance to East Asian countries. The issues are democratic transition and consolidation, social integration, economic development and human rights protection. In the third dimension, this project looks into regional networking of East Asian constitutional courts.
